3. Access & Security

 

Access to livestreams or digital content may be provided via login, link, token, or other access method.

• You are responsible for maintaining the confidentiality of access details

4. Livestream Services

 

 

4.1 Nature of the Service

 

We provide broadcast services only.

We do not organise, manage, control, or operate the events being broadcast.

 

 

4.2 Event Schedules & Changes

 

Event schedules, formats, race orders, qualifying sessions, and content may change at any time due to circumstances beyond our control, including but not limited to:

 

• Technical failures (including timing or scoring systems)

• Safety or operational decisions

• Weather conditions

• Decisions by officials, race control, or organisers

 

Schedule or format changes do not automatically entitle viewers to a refund, provided a livestream is delivered.

 

 

5. Purchases & Pricing

 

All prices are listed in New Zealand Dollars (NZD) unless stated otherwise and include GST where applicable.

 

By completing a purchase, you authorise us to charge the payment method provided.

 

We reserve the right to correct pricing errors or withdraw services where necessary.

 

 

6. Refunds & Cancellations

 

 

6.1 No Change-of-Mind Refunds

 

Refunds are not provided for change of mind, including but not limited to:

 

• Inability to watch live or at a later time

• Preference for specific races, sessions, or qualifying formats

• Personal scheduling conflicts

• Dissatisfaction with event outcomes or organiser decisions

 

 

6.2 Schedule or Program Changes

 

Changes to event schedules, formats, or session timing do not constitute a failure of service where a livestream is delivered.

 

 

6.3 Major Failure

 

If there is a major failure of the livestream service within our control (for example, the livestream is not delivered at all), remedies may include a refund, credit, or alternative access, in accordance with the Consumer Guarantees Act 1993.

 

 

6.4 Discretionary Remedies

 

Any refunds or credits provided outside statutory obligations are offered at our discretion and do not create an ongoing obligation or precedent.

 

 

7. Technical Limitations

 

Livestreaming involves inherent technical risks.

 

We are not responsible for interruptions, delays, or reduced quality caused by:

 

• Viewer internet connectivity or device limitations

• Venue or third-party network failures

• Power outages

• Infrastructure failures beyond our reasonable control

 

We take reasonable care and skill but do not guarantee uninterrupted or error-free service.

 

 

8. Intellectual Property

 

All video, audio, graphics, and related content are owned by The Broadcast Co Ltd or its licensors.

 

You must not:

 

• Record, copy, or download the stream

• Rebroadcast or redistribute content

• Use content for commercial purposes

 

without our prior written consent.

 

 

9. Liability

 

To the maximum extent permitted by law:

 

• We are not liable for indirect or consequential loss

• We are not responsible for actions, decisions, or failures of event organisers or officials

• Our total liability is limited to the amount paid for access to the relevant service

 

Nothing in these Terms excludes rights under New Zealand consumer law.

 

 

10. Indemnity

 

You agree to indemnify and hold harmless The Broadcast Co Ltd from any loss, damage, or expense arising from:

 

• Your misuse of the website or services

• Your breach of these Terms

• Unauthorised sharing or redistribution of access
